Terms of service
The rules for using the Stackt Marketing website and the general terms that sit behind our marketing services.
1. Accepting these terms
Stackt Marketing is a business name used by a partnership between Lochie John Burgdorf and Adrian Fowler, who operate from Mudgeeraba on Queensland's Gold Coast. Wherever these terms say "Stackt", "we", "us" or "our", they refer to that partnership.
By visiting or using our website, or by using our services, you accept these terms. If you don't accept them, please don't use the site or our services.
2. What we offer
Stackt provides marketing and business technology services to Australian businesses. Depending on what a client needs, that can include:
- website design and build
- running Google Ads and Meta Ads campaigns
- search engine optimisation (SEO)
- looking after social media accounts
- writing and producing content
- brand and graphic design
- photography and video
- reporting on marketing results
- artificial intelligence (AI) business integration, including automating workflows, connecting software and building internal systems and dashboards
The exact scope, deliverables and fees for each client are set out in that client's own proposal or service agreement. Where those documents differ from these terms, the signed agreement takes priority.
3. Using the site
You may only use this website for lawful purposes. When using it, you must not:
- break any law or regulation that applies to you
- try to get into any part of the site or its systems without permission
- scrape or harvest content with bots or other automated tools
- upload or send viruses, malware or any other harmful code
- pretend to be another person or organisation
- disrupt or interfere with the site or the servers it runs on
4. Free review and resources
We offer a free marketing review and may publish guides, checklists and other resources on this site. These are general information only and are provided as they are. We work to keep them accurate but don't warrant that they are complete or correct for your situation.
Nothing free on this site is professional advice for your business. For advice that fits your circumstances, talk to us directly.
5. Intellectual property
The text, graphics, logos, photos, video and code on this website belong to Stackt or to the people who licensed them to us, and are protected by Australian and international copyright law.
You need our written permission before copying, sharing, changing or building on any of that material.
Who owns the work we produce for a client is covered in that client's service agreement.
6. Your part as a client
If you engage us, you agree to:
- give us information that is accurate and complete when we need it
- reply to requests for approvals and feedback promptly
- make sure you have the right to use any material you hand to us
- pay our invoices on the payment terms we agreed
- follow the laws and regulations that apply to your business
7. Use of artificial intelligence
(a) We may use artificial intelligence tools, automation tools and other technology systems (AI Tools) to assist in the delivery of our marketing, website and technology services, including research, copywriting and content preparation, design, data analysis and reporting, campaign management, project management, administration and productivity functions.
(b) We will take reasonable steps to ensure that any AI Tools used by us are utilised in a manner consistent with our obligations concerning confidentiality, privacy, security and our professional obligations.
(c) The use of AI Tools does not reduce or affect our responsibility for the services provided to you. All work, advice and communications remain subject to our professional judgment and review.
(d) You may provide reasonable written instructions regarding the use of AI Tools in relation to your work with us. Any such instructions may affect the manner in which services are provided, the time required to complete work, and the fees incurred.
8. Limits on liability
As far as the law allows, Stackt is not liable for indirect, incidental, special, consequential or punitive loss, including lost profit, lost data or lost business opportunities.
For any claim arising from our services, our total liability is capped at the amount you paid us for those services in the 12 months before the claim arose.
These terms do not exclude or limit any right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded or limited.
9. No guaranteed results
We work hard to get results, but we can't promise particular outcomes such as search rankings, a number of leads or growth in revenue. Marketing performance depends on plenty we don't control, including the platforms themselves, your market, your competitors and how your business runs.
Apart from anything the ACL says we must provide, the website and our services come without warranties of any kind, whether express or implied.
10. Ending an agreement
Either side can end a service agreement by giving written notice in the way that agreement sets out. When an agreement ends:
- any unpaid invoices fall due straight away
- we'll give you reasonable help handing the work over
- you keep ownership of any deliverables you have paid for in full
11. Governing law
Queensland law governs these terms. Any dispute about these terms or our services is subject to the exclusive jurisdiction of the Queensland courts.
12. Updates to these terms
We may change these terms from time to time; check the date under the heading to see which version you're reading. If you keep using the site or our services after a change, you accept the updated terms.
